Consumers and businesses alike are increasingly using financial services digitally. Digital business innovations require a new perspective on the legal framework. Who is liable for a mistake made by a robo-investment advisor? How are crypto assets and crowdfunding regulated? What are the data protection challenges associated with the use of Big Data? In addition to these questions, the course will also address other legal challenges and opportunities related to digitalisation, in particular digital finance.

After completing the course, students will be able to identify the legal characteristics of digital finance. Students will also become familiar with recent legislation on the subject and learn to identify the legal challenges and opportunities associated with digital finance.

The course contributes to the following UN Sustainable Development Goals (SDGs):

SDG 8 – Decent Work and Economic Growth
Students will analyse how digital finance regulations contribute to economic growth while ensuring financial stability. We will examine the legal framework for fintech innovations, including robo-advisors, digital payments, and crowdfunding.

DG 9 – Industry, Innovation, and Infrastructure
The students learn to assess how legal frameworks such as MiCA (Markets in Crypto-Assets Regulation) support responsible innovation in financial technology. We will explore regulatory approaches to safeguarding digital finance infrastructure, including cybersecurity and fraud prevention.

SDG 12 – Responsible Consumption and Production
Students will examine liability frameworks for digital financial services, including robo-advisors and automated decision-making. We will analyze legal obligations under PSD2 (Revised Payment Services Directive) and MiCA to ensure transparency, fairness, and ethical use of digital financial tools.

SDG 16 – Peace, Justice, and Strong Institutions
Students will assess legal challenges related to GDPR (General Data Protection Regulation) and its impact on Big Data and AI-driven financial services. We will examine regulatory measures ensuring fair treatment, privacy, and cybersecurity in digital finance.

SDG 17 – Partnerships for the Goals
We will explore international regulatory initiatives, including MiCA and PSD2, and collaboration in fintech, crypto assets, and digital banking. We will analyse the role of cross-border financial regulation in addressing emerging risks and opportunities in digital finance.
